TERMS AND CONDITIONS – NAMORA Last updated: 3 March 2026 1. Scope These Terms and Conditions apply to the use of the Progressive Web App (PWA) "Namora" and all related services. The provider is Jens Allmer (individual). 2. Description of Services Namora is a baby name exploration and selection application. It provides name search, random name dealing, letter-based filtering, name collection, and community-driven dictionary enrichment features. The service is provided "as is", without any guarantee of availability, features, or error-free operation. 3. Registration and User Account Certain features require the creation of a user account. Users must provide accurate information and keep their access credentials confidential. 4. User Obligations Users are responsible for all content they enter within the application (e.g. names, exclusion reasons, profile information). Misuse of the service or violation of applicable laws is prohibited. 5. Fair Usage Policy The Namora name database is a proprietary compilation of over 500,000 names. Users agree to the following fair usage terms: a) The database and its contents may only be accessed through the Namora application interface. Any attempt to systematically download, scrape, mirror, extract, or reproduce the database or substantial portions thereof is strictly prohibited. b) Automated access, bulk queries, or any use of scripts, bots, or similar tools to extract data from the service is prohibited. c) Daily request quotas are enforced to ensure fair access for all users. Circumventing these quotas is a violation of these terms. d) The data obtained through Namora may be used only for personal, non-commercial name selection purposes. 6. Name Content and Cultural Sensitivity The Namora database contains names from many cultures, languages, and regions worldwide. a) A name that may carry negative or offensive connotations in one language or culture may be a perfectly ordinary or even revered name in another. The provider does not guarantee that any name is free from unintended associations in every language or cultural context. b) Users acknowledge that the inclusion of a name in the database does not constitute an endorsement or recommendation by the provider. c) The provider shall not be liable for any offense, misunderstanding, or negative consequence arising from the cultural or linguistic interpretation of names contained in the database. d) Users are encouraged to research the cultural significance of any name they consider selecting independently. 7. Crowd-Sourced Data Namora collects anonymized information about names searched for but not found in the database. This data is used solely to identify potential additions to the dictionary and improve the service. No personal data is used for this purpose beyond the anonymized name string. 8. Suspension and Termination The provider reserves the right to suspend or terminate user accounts in cases of misuse, violations of these terms (including fair usage violations), or for security reasons. Users may delete their account at any time. 9. Paid Services and Withdrawal Paid services, if offered, are provided at the prices displayed at the time of purchase. Consumers have a 14-day right of withdrawal. Details are set out in the Withdrawal Policy. 10. Liability The provider is fully liable for intent and gross negligence. In cases of simple negligence, liability is limited to breaches of essential contractual obligations and to foreseeable damages. Mandatory statutory liability remains unaffected. The provider is not liable for: - Offensive interpretations of names across different languages or cultures - Decisions made based on information provided by the service - Temporary unavailability of the service 11. Changes to the Services The provider reserves the right to modify, extend, or discontinue features, provided this is reasonable for users. 12. Data Protection Personal data are processed in accordance with the Privacy Policy. 13. Governing Law and Jurisdiction German law applies. Where legally permissible, the place of jurisdiction is the provider's place of business. 14. Language Version The German version of these Terms is legally binding. Translations are provided for convenience only. 15. Final Provisions If individual provisions of these Terms are invalid, the remaining provisions shall remain effective.
